Terms of Service

1. Introduction

Welcome to YoiBonsai (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of the YoiBonsai mobile application, website, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account.

You may not use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.

3. Your Content

You retain ownership of all content you upload to the Service, including photos, text, and tree data (“Your Content”). By uploading content, you grant us a limited license to store, display, and process Your Content as necessary to provide the Service.

You are responsible for ensuring that Your Content does not violate any third-party rights or applicable laws. We reserve the right to remove content that violates these Terms.

4. Ichiba Marketplace

YoiBonsai includes a marketplace feature (“Ichiba”) that allows users to list trees for sale and connect with potential buyers. The following terms apply specifically to Ichiba:

4.1 YoiBonsai Is Not a Party to Transactions

YoiBonsai provides a platform for buyers and sellers to connect. We are not a party to any transaction between users. We do not process payments, handle shipping, hold funds in escrow, or guarantee the completion of any sale. All pricing, negotiation, payment, and shipping arrangements are made directly between the buyer and seller.

4.2 No Warranties on Listings

We do not verify, endorse, or guarantee the accuracy of any listing, including descriptions, photos, species identification, or asking prices. Buyers should exercise their own judgment and due diligence before completing any purchase.

4.3 Seller Responsibilities

Sellers are responsible for the accuracy of their listings, including descriptions and photos. Sellers must comply with all applicable laws regarding the sale and shipment of live plants, including any state, federal, or international regulations.

4.4 Disputes

YoiBonsai does not mediate or resolve disputes between buyers and sellers. Any disagreements regarding transactions, including issues with payment, shipping, or the condition of items, must be resolved directly between the parties involved.

4.5 Prohibited Listings

You may not list or sell:

  • Trees or plants collected illegally or in violation of conservation laws
  • Protected or endangered species without proper permits and documentation
  • Items other than bonsai trees, pots, tools, and related bonsai supplies
  • Counterfeit or misrepresented items

5. Subscriptions

YoiBonsai offers an optional Premium subscription that unlocks unlimited trees, sharing, transfers, AI-assisted features, marketplace listing, and direct messaging. Without Premium you can still use the App with up to 10 trees and view the marketplace.

5.1 Pricing and billing

Premium is sold as monthly or annual subscriptions through Google Play. Current pricing is shown in the YoiBonsai Android app on the Subscription screen and in the Google Play Store listing. We may change prices for new subscriptions at any time; existing subscribers will be notified before any change to their renewal price.

5.2 Auto-renewal

Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before renewal. Renewal is handled entirely by Google Play and charged to the Google Play account associated with the device.

5.3 Cancellation

You can cancel your subscription at any time through the Google Play Store. Open the Play Store app, tap your profile icon, choose Payments & subscriptionsSubscriptionsYoiBonsaiCancel subscription. After cancellation you keep Premium access through the end of your current billing period.

5.4 Refunds

Refunds for subscription purchases are handled by Google Play under their standard refund policy. We do not directly process payment refunds. If you have a refund issue we cannot resolve through Google Play, contact us at support@yoibonsai.com.

5.5 What happens when Premium ends

When your subscription ends and a 7-day grace period elapses, Premium features (sharing, marketplace listing, direct messaging, AI features) become unavailable. Your trees, photos, reminders, and account remain. If you have more than 10 trees, the first 10 (by creation date) stay editable; the rest become read-only until you renew.

6. Messaging

The Service includes a messaging feature for communication between users. You agree to use messaging responsibly and not to send spam, harassment, threats, or inappropriate content. We may review messages reported by users in order to investigate violations of these Terms. We do not proactively monitor private conversations between users.

7. Limitation of Liability

To the fullest extent permitted by law, YoiBonsai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to losses arising from marketplace transactions between users.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases, but these Terms survive to the extent they apply to prior use.

9. Copyright and DMCA

YoiBonsai respects intellectual property rights. If you believe a user has uploaded content that infringes your copyright, send a DMCA notice to support@yoibonsai.com that includes: a description of the copyrighted work, a link to the infringing content on our service, your contact information, and a good-faith statement that you are authorized to act on the copyright owner's behalf. We will respond within a reasonable time and may remove the infringing content while we investigate.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
